1. Content Usage Policy
Pop Quiz Pro is designed to help students and learners generate study materials, quizzes, flashcards, and notes using artificial intelligence, and to collaborate in small study groups through our CoWork Sessions feature. We take the responsible use of our platform seriously and require all users to observe the following guidelines.
Compliance with Institutional Policies
Users must not input, upload, or submit any material that violates the policies of their school, college, university, workplace, or instructor. It is your responsibility to understand and comply with your institution's rules regarding the use of AI tools, the recording of educational materials, and the distribution of academic content.
Adherence to Copyright Law
Users must not submit copyrighted material to the Services unless they have obtained explicit permission from the copyright holder or the use is otherwise permitted by law. This includes text, images, lecture materials, textbook content, audio recordings, and any other form of copyrighted work. Pop Quiz Pro processes submitted content through AI to generate study materials, but this does not grant any license to the underlying copyrighted material. See Section 6 (Content and Copyright Policy) and Section 13 (DMCA) for additional detail.
Respecting Privacy
Users are prohibited from submitting sensitive personal information belonging to others, including private conversations, confidential communications, health information, financial data, or any content that would breach privacy laws and regulations in the United States. Do not submit content containing Social Security numbers, medical records, financial account details, passwords, or other sensitive personal data.
Liability
Pop Quiz Pro does not pre-screen user-submitted content. We run automated content safety filters on images and AI interactions through the Google Gemini API, and we run a client-side profanity filter on direct user-to-user text in CoWork Chat and on the CoWork Board, but we do not review content in advance. We are not liable for content submitted by users that violates institutional policies, copyright law, or privacy regulations. By using the Services, you agree to indemnify and hold harmless Pop Quiz Pro and its operators against any claims, damages, or legal actions arising from your use of the Services or any content you submit.
2. License to Use the Services
Subject to your compliance with these Terms, Pop Quiz Pro grants you a limited, personal, non-exclusive, non-commercial, revocable, and non-transferable license to access and use the Services for your personal educational purposes.
You agree not to:
- Access, copy, or extract content or data from the Services through automated means, including but not limited to scripts, bots, spiders, crawlers, or scrapers, unless expressly permitted in writing by Pop Quiz Pro.
- Share, transfer, or sublicense your account or subscription to any other person.
- Use the Services for any commercial purpose, including but not limited to reselling generated content, operating a competing service, or training third-party AI models.
- Attempt to reverse-engineer, decompile, or disassemble any portion of the Services, or modify the client to bypass permission checks, subscription validation, content safety filters, or ban enforcement.
- Interfere with or disrupt the integrity, security, or performance of the Services.
Subscriptions are for individual use only. Pop Quiz Pro may establish reasonable limits on your use of the Services, including limits on the number of quizzes generated, content processed, Gemini API calls per minute and per day, or devices used, to prevent abuse or unauthorized access.
3. Account Registration and Age Requirements
Account Creation
To access the Services, you must create an account by providing a display name, email address, and birth month and year, and either signing in through Google or Apple, or creating credentials with an email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. A user under 13 must also provide a parent or guardian email address and parent or guardian phone number during signup; the parent email is used to obtain per-interaction verifiable parental consent as described in the Kid Mode section below, and the parent phone number is used exclusively as a secondary contact channel if the parent email becomes undeliverable.
Minimum Age
Pop Quiz Pro is available to users aged 13 and older through the standard signup flow. Users under 13 may use Pop Quiz Pro through Kid Mode, a parent-in-the-loop experience that complies with the Children's Online Privacy Protection Act ("COPPA"). Kid Mode is available in v3.0 at launch. During signup you will be asked to provide your birth month and year. This is required to create an account and cannot be changed after onboarding except by contacting support. The Kid Mode flow and the per-interaction verifiable parental consent mechanism are described in full in Section 6 of the Privacy Policy.
Kid Mode
A Kid Mode account has access to the same features as an adult Freemium account, including CoWork Sessions. However, any social interaction that discloses information from a Kid Mode account to another user — including inbound and outbound CoWork invitations, direct messages, and session join requests — is held in a pending state and emailed to the parent on file for approval. The parent may approve the interaction for a discrete time window (for Kid Mode ↔ adult interactions: 2 hours, 6 hours, 12 hours, 1 day, 7 days, 30 days, or until revoked; for Kid Mode ↔ Kid Mode interactions: 1 day, 7 days, 30 days, or until revoked) or deny it. Approvals are per-contact and time-bounded. Both parents must independently approve an interaction between two Kid Mode accounts. Pending invitations expire after 7 days if the parent does not act. A parent may revoke any active approval at any time by emailing Pop Quiz Pro from the registered parent email address with the subject "revoke" or "revoke all." If the parent email on file returns hard bounces, the child may continue to use all solo features, any previously-approved CoWork contacts, and any documents or study guides already received through CoWork without interruption; only new CoWork communication actions that require a new parental approval are held until the parent email is re-verified. Pop Quiz Pro sends an SMS to the parent phone number on file with a link to enter a new email address; if the parent does not respond within seven days, the child is directed to ask the parent to email parent@popquizpro.ai from the new address to rebind it manually. When a Kid Mode user reaches their 13th birthday (calculated from the birth month and year provided at signup), the account automatically transitions out of Kid Mode on next login and prompts the user to add a display name and review the standard Privacy Policy and Terms.
SMS Messaging Program (Kid Mode Account Recovery)
Program name: Pop Quiz Pro Account Recovery.
Program description: When a parent or guardian of a Kid Mode user enrolls a Kid Mode account, Pop Quiz Pro collects the parent's mobile phone number at signup. The phone number is used exclusively as a secondary contact channel to help the parent recover access if the parent email address on file becomes undeliverable. Pop Quiz Pro sends the parent a one-time text message with a secure link to enter a new email address, plus occasional transactional follow-ups related to that recovery flow. The phone number is not used for marketing, advertising, or promotional purposes, and is never shared or sold to third parties.
Message frequency: Infrequent. A parent typically receives a text message only if the parent email on file starts returning delivery failures. Most parents never receive a text message from Pop Quiz Pro.
Message and data rates: Message and data rates may apply. Messaging frequency varies. Charges from your mobile carrier are not controlled by Pop Quiz Pro.
How to opt out: Reply STOP to any Pop Quiz Pro text message at any time to immediately opt out of further text messages. After opting out, you will receive a single confirmation text and no further messages will be sent to that phone number. You may re-enroll at any time by updating the parent phone number on file in your Kid Mode account settings and confirming re-enrollment.

Supported carriers: All major U.S. mobile carriers are supported. Carriers are not liable for delayed or undelivered messages.
Delivery provider: Pop Quiz Pro delivers text messages through Twilio, a third-party telecommunications provider.
Eligibility: The SMS program is available only within the United States. Only parents and legal guardians enrolling a Kid Mode account, who own or control the mobile phone number provided, should submit a phone number.
Age-Based Data Collection
Data collection practices differ based on age and are described in detail in the Privacy Policy:
- Users ages 13-15 are subject to minimal data collection (account and content data only; no usage analytics). Their data is never included in aggregated datasets or shared with third parties for commercial purposes.
- Users 16 and older are subject to full data collection, including usage analytics, feature usage, study performance, subject data, and CoWork engagement.
- Users 18 and older may have their data included in aggregated, de-identified datasets as described in the Privacy Policy.
When a user reaches a qualifying age based on the birth month and year provided, data collection settings for new activity update automatically. Prior activity from when the user was younger is not retroactively reclassified.
Account Deletion
You may delete your account at any time from the in-app settings. Deleting your account removes your Personal Information from our active databases, subject to limited retention required by law, mandatory reporting obligations, enforcement of these Terms, and tax and accounting requirements. See the Privacy Policy for details.
4. Subscriptions and Payment
Subscription Plans
Pop Quiz Pro offers the following subscription plans:
- Premium Monthly: $10.00 per month, billed monthly. This works out to approximately $0.33 per day.
- Premium Annual: $60.00 per year, billed once per year as a single $60.00 charge. This works out to approximately $5.00 per month and $0.17 per day — 50% off the monthly rate. The annual plan is marketed as "$5.00/month billed annually" in Pop Quiz Pro's upgrade screens to make the savings legible, but the actual charge is a single $60.00 transaction once per year, not a monthly $5.00 installment.
Subscription prices are subject to change. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle.
Payment Processing
Subscriptions purchased through the iOS App are processed by Apple through In-App Purchase and managed by Apple's StoreKit. Subscriptions purchased through the Android App are processed by Google through Google Play Billing. Pop Quiz Pro does not receive, store, or process your credit card, debit card, or other payment instrument details. All payment data is handled directly by Apple or Google according to their respective terms and privacy policies.
For subscriptions purchased through the website, payment is processed by a PCI-compliant third-party payment processor. Pop Quiz Pro receives transaction confirmation information (subscription type, purchase date, and contact information) but does not receive your full payment card details.
Server-Side Validation
Pop Quiz Pro validates your subscription state server-side against Apple's App Store Server API and Google Play's Developer API, and responds to lifecycle events (renewals, refunds, billing grace periods, upgrades, cancellations) through Apple's App Store Server Notifications v2 and Google's Real-Time Developer Notifications. Your subscription state on our servers is authoritative; client-side claims of Premium status are not.
Grace Period
If a subscription renewal fails, Apple and Google provide a billing grace period during which your access to Premium features, including CoWork hosting and contribution, is preserved. The app will prompt you to update your payment method during the grace period. If the issue is not resolved by the end of the grace period, your subscription will lapse and your account will transition to Freemium per Section 5 below.
Refund Policy
Due to the digital nature of the Services, refunds are provided only in cases where a technical malfunction or defect prevents you from accessing or using the features included in your subscription, and we are unable to resolve the issue. To request a refund, contact our support team at info@popquizpro.ai within 30 days of your purchase with a detailed description of the issue.
For subscriptions purchased through the Apple App Store or Google Play Store, refund requests are also subject to the respective platform's refund policies. Pop Quiz Pro acts on refund events received through the platform webhooks and will downgrade affected accounts accordingly.
Premium Features
Premium subscribers receive access to the following features in addition to the free tier:
- Unlimited AI-powered quiz, flashcard, and note generation.
- Unlimited active sessions (Freemium is capped at 3; see Section 5).
- CoWork Sessions hosting and contribution — create groups, invite members, post in chat, edit the Board, schedule sessions, share voice transcripts from Study Room Live Mode (v3.1), and access AI Session Recap (v3.1).
- Audio input and transcription — upload audio files, record live audio, and receive AI transcriptions.
- Full export methods — PDF, email, and native Text (SMS) sharing of sessions and final guides.
- Additional backup options beyond the standard archived recovery backup that every account receives: automatic daily backups to your own iCloud Drive (Apple devices) or Google Drive (Android devices) with the last 3 versions retained for user-accessible version history.
- Manual on-demand backup, restore, and archive flows.
- Priority AI processing.
- Additional study tools and features as they become available.
The specific features included in premium subscriptions may change over time. We will communicate any material changes to premium features in advance.
Cancellation
You may cancel your subscription at any time. For in-app subscriptions, cancellation is managed through your Apple ID or Google Play account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. After the billing period ends, your account will revert to the Freemium tier as described in Section 5.
Delivery
All Services are delivered digitally. Upon purchase or account creation, you receive immediate access to the applicable features. No physical goods are shipped.
5. Downgrade and Freemium Soft Archive
When your Premium subscription ends (by cancellation, lapse, or refund), your account is not deleted and your content is not destroyed. Pop Quiz Pro uses a soft-archive model so that the path back to Premium is always frictionless:
- Active session cap. Freemium users can keep up to 3 sessions "active" at a time. Study materials received through CoWork (such as study guides shared by other members) can be used but each one occupies a slot in the 3-session cap. If all 3 slots are occupied, the user must delete or archive an existing session before they can use a new study guide received through CoWork. Sessions above the cap are marked archived, not deleted.
- Swap-to-activate. You can tap any archived session to swap it with one of your active sessions at any time, one-for-one.
- Automatic reactivation. If you resubscribe to Premium, every archived session is automatically returned to active status with no restore step and no data migration.
- CoWork downgrade. Existing CoWork groups you host remain accessible to all members after your downgrade. You retain read access and host administrative powers (remove members, cancel events, delete the group) but cannot post chat, edit the Board, or contribute shared material while Freemium. Group members are notified once that new content can only be added if you resubscribe.
- 30-day undo window. For 30 days after cancellation, a "Reactivate Premium" option in settings restores your subscription without re-running the platform purchase flow. A confirmation email is sent within 60 seconds of any cancellation so that unexpected cancellations can be caught early.
- Archived data is not automatically deleted. Archived data is removed only when you delete your account or when you explicitly delete the underlying sessions.
6. Content and Copyright Policy
Pop Quiz Pro respects the intellectual property rights of all individuals, including educators, authors, and institutions.
Prohibited Actions
The following actions are prohibited on Pop Quiz Pro:
- Submitting copyrighted textbook content, lecture materials, or exam questions without authorization from the copyright holder or another legal basis.
- Using the Services to reproduce, distribute, or share copyrighted materials in a manner that infringes on the rights of the copyright holder.
- Using AI-generated output to misrepresent the source or originality of academic work.
Consequences
Violation of this policy may result in the removal of content, restriction of CoWork access under Section 9, suspension of account access, permanent termination of your account, or legal action.
7. AI-Generated Content
Pop Quiz Pro uses Google's Gemini API, including the Gemini Live API for voice features, to generate study materials, quiz questions, flashcards, notes, lecture transcripts, voice-session transcripts, and other educational content. You acknowledge and agree that:
- AI-generated content is provided for educational and study purposes only and should be used as a supplement to, not a replacement for, your own learning and study efforts.
- AI-generated content may contain errors, inaccuracies, or incomplete information. Pop Quiz Pro does not guarantee the accuracy, completeness, or reliability of any AI-generated content.
- The text, images, and audio you submit to the Services are transmitted to Google's Gemini API for processing. This transmission is necessary to provide the Services and is governed by Google's terms and privacy practices.
- Every Pop AI call configures Gemini's safety settings at the strictest available threshold for harassment, hate speech, sexually explicit content, and dangerous content. Submissions that trip these filters will be rejected and not saved.
- The primary copy of the personal study content you create or upload is stored on your device, and Pop Quiz Pro keeps an archived backup copy of that content on our servers tied to your authenticated account so that you can recover it if your device is lost or replaced. CoWork content (content you post inside a CoWork group) is stored on our servers in Google Firebase Firestore as the primary copy because it must be visible to every member of the group. These storage arrangements are described in detail in the Privacy Policy.
Voice Transcripts in Study Room Live Mode (v3.1)
If you use Study Room Live Mode in a future release, you speak directly to Pop AI and Gemini Live generates a text transcript of the conversation. At the end of each Live Mode session, you choose one of three dispositions: share the transcript with your CoWork group, keep it privately in your CoWork notes for that group, or discard it. Discarded transcripts are not written to our database. Other users in the group do not hear the live audio. Voice transcripts are subject to the same content rules as every other Pop AI output.
8. User-Generated Content and CoWork Community Guidelines
Pop Quiz Pro's CoWork Sessions feature lets you collaborate with other users in small, invite-only study groups. CoWork includes shared study sessions, a group chat with a Chat button and a POP ai button, a collaborative Board (markdown notes), an activity feed, scheduled events, and Study Room Live Mode voice sessions in a future release. This section governs the content you contribute to CoWork and the behavior expected of every member.
8.1 Your License to Pop Quiz Pro
You retain ownership of the content you create or upload to the Services. By submitting content to CoWork — whether through shared sessions, chat messages, Board edits, voice transcripts, uploaded images and audio, or any other CoWork surface — you grant Pop Quiz Pro a worldwide, non-exclusive, royalty-free license to store, host, reproduce, transmit, display, and process that content solely for the purposes of operating, improving, and providing the Services to you and to the other members of your groups, enforcing these Terms, and complying with our legal obligations. You represent that you have the right to submit the content and that doing so does not violate any third-party rights.
8.2 Visibility Inside a Group
Content you post to a CoWork group is visible to every member of that group as an inherent function of the collaborative product. You should treat anything you post to a CoWork group as visible to all group members. Email addresses are visible only to the group host; non-host members see display names and avatars.
8.3 Community Guidelines — Prohibited Conduct
When using CoWork (or any user-visible surface of the Services, including display names and group names), you agree not to:
- Post, upload, transmit, or share content that is unlawful, defamatory, harassing, threatening, abusive, hateful, fraudulent, or that infringes the intellectual property or privacy rights of others.
- Post, upload, transmit, or share sexual content, sexually explicit content, or any content that sexualizes, exploits, or endangers minors. Child sexual abuse material is strictly prohibited and will be reported to NCMEC and law enforcement as described in Section 8.6.
- Target other users with harassment, slurs, targeted attacks based on protected characteristics, or credible threats of violence.
- Impersonate another person, misrepresent your affiliation with any individual or institution, or use a display name or group name that is deceptive, offensive, or impersonating.
- Use CoWork to coordinate academic dishonesty or to solicit, distribute, or share exam content as prohibited by Section 10 (Honor Code).
- Attempt to circumvent, disable, or defeat the content safety filters, the profanity filter, the strike ladder, ban enforcement, report functions, block functions, or any other safety or permission mechanism in the Services.
- Automate signups, invites, chat messages, Board edits, or Gemini API calls through scripts, bots, or other non-human means.
- Share the personal information of other users beyond what is already visible inside the group.
8.4 Content Safety Enforcement
Pop Quiz Pro enforces a two-part content safety model described in detail in the Privacy Policy:
- Gemini-powered safety filters are applied to every image upload, every AI-generated output, every Pop Tutor response, every POP ai button response in CoWork chat, and every voice transcript from Study Room Live Mode. Submissions that trip these filters are rejected, not saved, and may be logged for review.
- A client-side profanity filter runs on direct user-to-user text in CoWork Chat and on the Board. Flagged text is written with a flag marker and rendered masked on receiving devices until the recipient chooses to reveal it. You may set the filter to strict, relaxed, or off; hosts may set a minimum strictness for their group that you cannot weaken below. Under-18 accounts default to strict.
8.5 Reports, Blocks, and Host Controls
Every CoWork surface includes a report button on content cards, chat messages, Board regions, and member cards. Reports are delivered to a secure review queue for human review. You may also block another user, which removes you and the blocked user from each other's visibility in shared group content. Group hosts can remove any member at any time, which immediately terminates that member's access to the group.
8.6 Mandatory Reporting of Child Sexual Abuse Material
Under 18 USC 2258A, Pop Quiz Pro is required to report apparent child sexual abuse material (CSAM) to the National Center for Missing and Exploited Children (NCMEC) through the CyberTipline. If we become aware of apparent CSAM on the Services, we will preserve the associated content, account identifiers, and metadata as required by law, freeze the account involved, and file the report. This obligation is not waivable and applies regardless of intent, context, or subscription status.
9. CoWork-Only Strike Ladder
Pop Quiz Pro enforces Community Guidelines violations in CoWork with a four-step CoWork-only strike ladder. The ladder restricts CoWork access only. Solo study features, Pop Tutor in personal sessions, and all non-CoWork app functionality remain available at every step, including after permanent CoWork loss. The principle is: keep the customer, restrict the feature.
- Strike 1 — Warning. You receive an in-app notice that shows the reported content, references the rule involved, and presents an Appeal button. No CoWork restriction is applied yet.
- Strike 2 — 7-day CoWork ban. Triggered only if Strike 1 was reviewed and confirmed. You lose CoWork chat send, Board edit, Live Mode, and the ability to join or host groups for 7 days. You retain read access for existing groups and all solo features. Appealable.
- Strike 3 — 30-day CoWork ban. Triggered only if Strikes 1 and 2 were reviewed and confirmed. Same scope as Strike 2, extended to 30 days. Appealable.
- Strike 4 — Permanent CoWork loss. Triggered only if Strikes 1, 2, and 3 were reviewed and confirmed. You permanently lose CoWork chat send, Board edit, Live Mode, and join/host privileges. The rest of the app continues to work. No appeal.
Strikes 1-3 decay after 12 months of clean record. Strike 4 does not decay. Severe violations — including child sexual abuse material, illegal content, targeted harassment, credible threats of violence, and attempts to circumvent safety systems — skip the ladder entirely and result in full account suspension and, where applicable, legal reporting.
Ban state is enforced at the Firestore security rule level, not only in the user interface, and is checked on every write to CoWork chat, Boards, sessions, and related surfaces.
Appeals for Strikes 1-3 are written to the same review queue as reports and are resolved within a reasonable time. While an appeal is pending, the associated strike consequence is paused.
10. Honor Code
Pop Quiz Pro is built to support genuine learning. Our AI-powered tools, including quiz generation, flashcards, notes, Pop Tutor, and CoWork's collaborative surfaces, are designed to help you study more effectively, not to circumvent the learning process.
The following uses of the Services are strictly prohibited:
- Using the Services to complete assignments, exams, or assessments that are meant to be done independently.
- Sharing generated quiz answers, test content, or assessment materials — whether inside a personal session, in CoWork chat, on a Board, in a shared study session, or through any other surface — for the purpose of academic dishonesty.
- Submitting AI-generated content as your own original work in academic settings where this is not permitted.
- Using the Services, including CoWork groups, to solicit, distribute, or facilitate access to exam questions or answers.
- Using CoWork groups as a coordination space for academic dishonesty, collusion, or the trading of restricted course material.
Pop Quiz Pro reserves the right to suspend, terminate, or restrict accounts found to be in violation of this Honor Code. We may cooperate with educational institutions investigating academic integrity violations, including sharing relevant account information, CoWork group content, and shared study material when required by law or institutional policy. Honor Code violations inside CoWork may be enforced either through the strike ladder in Section 9 or through direct account-level action, depending on severity.
We believe that effective learning comes from engagement with the material, not from shortcuts. Pop Quiz Pro is a tool to help you understand and retain knowledge, and we ask that all users respect that purpose.
11. Intellectual Property
All content, features, and functionality of the Services, including but not limited to the software, design, text, graphics, logos, and icons, are the property of Pop Quiz Pro and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you create or upload, subject to the license granted in Section 8.1.
AI-generated study materials produced by the Services in response to your input are provided for your personal educational use. You may not commercially distribute, sell, or license AI-generated output from the Services.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. POP QUIZ PRO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
POP QUIZ PRO DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT. YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS AND SHOULD NOT BE RELIED UPON AS A SOLE SOURCE OF INFORMATION.
POP QUIZ PRO DOES NOT WARRANT THE ACCURACY, APPROPRIATENESS, OR LEGALITY OF CONTENT POSTED BY OTHER USERS IN COWORK GROUPS. YOU INTERACT WITH OTHER COWORK MEMBERS AT YOUR OWN RISK AND ARE RESPONSIBLE FOR DECIDING WHICH GROUPS TO JOIN AND WHICH INVITES TO ACCEPT.
13. DMCA Designated Agent
Because CoWork lets users post study content, chat, and Board edits visible to other group members, the Services function as a user-generated content host for the purposes of the Digital Millennium Copyright Act ("DMCA"). Pop Quiz Pro maintains a designated agent for receiving notices of claimed copyright infringement under 17 USC 512(c).

Formal registration of the designated agent with the U.S. Copyright Office is in progress as a pre-launch step and will be reflected in these Terms and in the Privacy Policy when complete.
A valid DMCA notice must include:
- Your contact information (name, address, phone number, email).
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it within the Services (for example, the group name, session title, message, Board region, or URL).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POP QUIZ PRO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF POP QUIZ PRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
POP QUIZ PRO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO POP QUIZ PRO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Texas.
